Calibre Signal Terms of Service

Article 1 (Purpose)

These Terms set out the rights, obligations and responsibilities between opus89 (the "Operator") and users in connection with the use of the mobile application "Calibre Signal" (the "Service") provided by the Operator.

Article 2 (Definitions)

  1. "Service" means the mobile application and related services that provide news on US and East Asian markets, economic indicators, AI-based analysis and chat, market reports, and similar features.
  2. "User" means any person who uses the Service under these Terms, including "Guests" who browse without creating an account and "Members" who sign in with a social account.
  3. "Credits" means in-service usage units that are deducted when using certain features, such as AI chat.
  4. "Content" means all information provided within the Service, including news summaries, AI analysis, reports, and indicator data.

Article 3 (Posting and Amendment of the Terms)

  1. The Operator posts these Terms within the Service or on the official website (calibre-signal.com).
  2. The Operator may amend these Terms to the extent that the amendment does not violate applicable law.
  3. When amending the Terms, the Operator will give notice, stating the effective date and the reason for the amendment, at least 7 days before the effective date (30 days for changes unfavorable to users). Continued use of the Service after the effective date constitutes acceptance of the amended Terms.

Article 4 (Accounts)

  1. Membership registration is completed through social account authentication supported by the Operator, such as Google.
  2. Persons under the age of 14 may not register as members or use the Service. Users confirm at sign-up that they are 14 years of age or older.
  3. An account may be used only by its owner and may not be transferred or lent to others.
  4. Users are responsible for managing their account information and must notify the Operator immediately if unauthorized use is suspected.
  5. Members may terminate their membership at any time via the in-app account deletion feature or the contact channel in Article 15.

Article 5 (Nature of the Service — Important Investment Notice)

  1. All Content provided by the Service is for informational and educational purposes only. It is not intended as a recommendation to buy or sell any specific financial investment product, as investment advice, or as a basis for investment decisions.
  2. The Operator does not provide individualized investment advice tailored to a user's investment objectives or financial situation.
  3. AI-generated analysis and answers may contain errors, inaccuracies, or omissions. The completeness, accuracy, and timeliness of the Content are not guaranteed.
  4. All investment decisions and their outcomes are solely the responsibility of the user. The Operator is not liable for investment results based on the Content.
  5. The copyright of news content belongs to the respective original publishers; the Service displays the source and provides a link to the original article.

Article 6 (Credits)

  1. Credits are deducted in the amounts disclosed for each feature when using certain features, such as AI chat.
  2. Credits granted free of charge (sign-up, monthly grants, promotions, referral rewards, etc.) are non-refundable and subject to the conditions set by the Operator (grant amounts, validity period, expiry).
  3. Credits cannot be exchanged for cash and cannot be transferred to others.
  4. Credits obtained by improper means (multiple accounts, misuse of promotion codes, etc.) may be revoked.

Article 7 (Paid Services)

  1. The Operator may offer paid services such as subscriptions (membership) and credit packs; prices and details are displayed on the payment screen.
  2. Payments are processed through Apple App Store or Google Play in-app purchase; payments and refunds are governed by each store's policies and applicable law, including the Act on the Consumer Protection in Electronic Commerce, etc. of Korea.
  3. Subscriptions renew automatically unless cancelled; users may cancel at any time in their store account settings. After cancellation, the service remains available until the end of the already-paid period.
  4. Payments made by a minor without the consent of a legal representative may be cancelled in accordance with applicable law.

Article 8 (User Obligations — Prohibited Conduct)

Users must not engage in any of the following:

  1. Stealing or improperly using another person's account or personal information
  2. Interfering with the normal operation of the Service (bulk requests via automated means, exploiting vulnerabilities, abnormal access, etc.)
  3. Improperly obtaining credits or benefits, such as by creating multiple accounts or abusing promotion or referral codes
  4. Copying, crawling, redistributing, or commercially using Service content (news summaries, AI analysis, reports, etc.) without the Operator's prior consent
  5. Reverse-engineering or decompiling the Service, or creating derivative services
  6. Conduct that violates applicable law or public order and morals, or that is connected to a crime
  7. Using the Service to provide third parties with services that constitute investment advisory or quasi-investment advisory business

Article 9 (User Content)

  1. Rights to information entered into the Service by users (AI conversations, bookmarks, keywords, etc.) belong to the user.
  2. The Operator uses user content only to the extent necessary to provide the Service (storage, display, AI processing) and does not sell or disclose it externally. Matters concerning the processing of personal information are governed by the Privacy Policy.

Article 10 (Changes to and Suspension of the Service)

  1. The Operator may change or terminate all or part of the Service; material changes or termination unfavorable to users will be announced in advance.
  2. The Service may be temporarily suspended due to unavoidable circumstances such as system maintenance, failures, or force majeure.
  3. Provision of some Content may be delayed or suspended due to circumstances of external data providers (news and indicator suppliers, AI processing contractors, etc.).

Article 11 (Restriction of Use)

  1. If the Operator becomes aware that a user has materially breached these Terms or significantly disrupted the operation of the Service, the Operator may restrict the user's use of the Service or terminate the agreement after giving prior notice of the violation and the reasons. However, in unavoidable cases such as urgent security threats, notice may be given without delay after the measure is taken.
  2. Users may object to a restriction measure through the contact channel in Article 15.
  3. The Operator does not routinely monitor users' private content (such as AI conversations) and reviews it only to the minimum extent necessary when a violation comes to its attention for legitimate reasons, such as reports or signs of abnormal activity.

Article 12 (Intellectual Property)

  1. Intellectual property rights in the Service and in content created by the Operator (UI, AI-generated analysis expressions, reports, etc.) belong to the Operator.
  2. Rights to third-party content (news publishers, etc.) belong to the respective rights holders.

Article 13 (Limitation of Liability)

  1. The Operator is not liable for damage caused by events beyond its reasonable control, such as force majeure or failures of third-party services (cloud providers, app stores, external data suppliers, etc.).
  2. With respect to services provided free of charge, the Operator bears no liability except as specifically required by applicable law.
  3. Unless the Operator has acted intentionally or with gross negligence, the Operator's liability for damages is limited to the amount actually paid by the user to the Operator in the most recent 3 months.
  4. The investment notice in Article 5 takes precedence over this Article.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms are interpreted in accordance with the laws of the Republic of Korea.
  2. Disputes arising in connection with use of the Service shall be brought before the court of competent jurisdiction under the Civil Procedure Act of the Republic of Korea.
